Terms of Use

1. Acceptance of Terms

By accessing and using Counsel24 (the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Platform. We may modify these Terms at any time, and your continued use of the Platform constitutes acceptance of modified Terms.

2. License and Use

Counsel24 grants you a limited, non-exclusive, revocable license to use the Platform for lawful purposes only. You may not:

• Use the Platform for any illegal or unauthorized purpose
• Harass, threaten, or abuse other users or attorneys
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to the Platform
• Reverse engineer, decompile, or disassemble the Platform
• Use the Platform for commercial purposes without authorization
• Transmit viruses, malware, or harmful code
• Scrape or automatically collect data from the Platform

3. Your Responsibilities

You are responsible for:

• Accurate Information: Providing truthful, accurate information about yourself and your legal matter
• Confidentiality: Maintaining confidentiality of any login credentials or account information
• Lawful Use: Using the Platform only for lawful purposes
• Content: Any content you submit is your responsibility; you represent you have the right to submit it
• Compliance: Complying with all applicable South African laws and regulations

4. Referral Service

What Counsel24 Does:

• We are a referral platform only, not a law firm
• We match you with qualified attorneys based on your legal matter and location
• We share your information only with the attorney you're matched with
• We do not provide legal advice or represent you in any legal matter

What Counsel24 Does NOT Do:

• We do not guarantee that a matched attorney will accept your case
• We do not control attorney fees or billing practices
• We do not supervise attorney-client relationships
• We do not mediate disputes between you and matched attorneys
• We do not guarantee specific legal outcomes or results

Your Relationship with Attorneys: Once matched with an attorney, your legal relationship is directly between you and that attorney. Counsel24 is not party to the attorney-client relationship. You are responsible for reviewing the attorney's credentials, fees, and terms before engaging their services.

5. Not Legal Advice

Counsel24 does not provide legal advice. Information on our Platform, including articles, guides, and FAQs, is for informational purposes only and does not constitute legal advice. This information is general in nature and may not apply to your specific situation.

You should not rely on any information from Counsel24 as a substitute for legal advice from a qualified attorney. Always consult with a qualified attorney about your specific legal matter.

6. Intellectual Property

All content on Counsel24, including text, graphics, logos, images, and software, is the property of Counsel24 or its content suppliers and is protected by South African and international copyright laws.

You may not reproduce, distribute, transmit, display, perform, or otherwise use any content from Counsel24 without express written permission from Counsel24, except for personal, non-commercial use.

7. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Counsel24 provides the Platform "AS IS" without warranties of any kind, express or implied
• Counsel24 is not liable for any indirect, incidental, special, or consequential damages
• Counsel24 is not liable for loss of profits, data, or reputation arising from your use of the Platform
• Our total liability to you shall not exceed the amount you paid (if any) for using the Platform
• We are not responsible for attorney conduct, negligence, or malpractice

Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you. If any part of this limitation is found unenforceable, the remainder shall be enforceable to the maximum extent permitted.

8. Indemnification

You agree to indemnify, defend, and hold harmless Counsel24, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any South African law or regulation
• Your submission of false or misleading information
• Your infringement of any intellectual property rights

9. Termination

Counsel24 may terminate or suspend your access to the Platform immediately and without notice if you:

• Violate these Terms of Use
• Submit false or fraudulent information
• Engage in abusive or harassing behavior
• Attempt to gain unauthorized access to the Platform
• Use the Platform for illegal purposes

Upon termination, your right to use the Platform ceases immediately. All provisions that should survive termination shall do so.

10. Governing Law

These Terms of Use are governed by the laws of the Republic of South Africa, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the South African courts for any disputes arising from these Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if not possible, severed, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms of Use, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Counsel24 regarding your use of the Platform and supersede all prior agreements and understandings.
